  1.               DavisWARE Liscense Agreement and Order Form

  4.       Software written and distributed by James R. Davis will hereby be
  5. known as DavisWARE.  Any references therein this document to DavisWARE
  6. will mean any software that has been written by James R. Davis and the
  7. copyright notification within the program itself.  For the latest updates
  8. and full technical support call the Programmer's Mega-Source BBS at
  9. (516) 737-4637.

  11.       DavisWARE is Copyrighted by James R. Davis as of October 1992 and
  12. is covered by US and International Copyright laws.  The author reserves
  13. all rights.
  14.  
  15. Liscense:
  16.  
  17.    You are granted a limited liscense to use DavisWARE for a thirty (30)
  18. day period for the purpose of evaluating it for your own use.  After
  19. thirty days, you are required to either register DavisWARE or stop using
  20. it. To continue using it is a violation of copyright laws and just not a
  21. nice thing to do..

  23.    The Shareware version of DavisWARE is NOT crippled in any way.  There
  24. are no missing features or timers.  The only differences between the
  25. registered and unregistered versions of DavisWARE are, the Shareware
  26. version places the word "UNREGISTERED" in the bulletin and displays the
  27. UNREGISTERED logo on the computer screen as part of the copyright
  28. notice, or within some programs a small feature may not be available.
  29.  
  30. BBS Distribution:
  31.  
  32.    BBSs are granted a limited liscense to distribute DavisWARE in a
  33. compressed format.  The distributing BBS is not limited to the type of
  34. compression method used for distribution.  However, the BBS must follow
  35. the following guidelines:
  36.  
  37. 1. If DavisWARE is distributed in a ".ZIP" file, the BBS must do it's
  38.    best to preserve the "AV" that DavisWARE was compressed with by the
  39.    author.  If a BBS wishes to have DavisWARE sent to them directly
  40.    from the author, please contact the author and a copy will be sent
  41.    either by US Mail, or uploaded directly to the BBS.  The sole
  42.    exception to distribution of DavisWARE without the security "AV"
  43.    placed by the author is where a BBS uses a program to validate their
  44.    uploads that, as a part of validation, reZIP's the file for maximum
  45.    compression (not necessary since the distribution archive from the
  46.    author is created with maximum compression enabled).

  48. 2. No BBS may, in re-ZIPing DavisWARE, add to the ".ZIP" their own "AV"
  49.    which does not belong to the author.
  50.  
  51. 3. No BBS is authorized to add any files to the archive which are not
  52.    part of the original DavisWARE archive as distributed by the author.
  53.    The sole exception is where a BBS adds an ASCII text file (containing
  54.    no ANSI codes of any type) as an advertisement, and the filename for
  55.    the file has not and/or will not change, and the BBS does not "cycle"
  56.    filenames for the purpose of "fooling" upload checking programs from
  57.    other BBSs which remove such advertisements.

  59. 4. No user may be charged any additional fee just to download DavisWARE
  60.    from the BBS.
  61.  
  62. Shareware Vendor Distribution:
  63.  
  64.    This copyrighted software and its documentation is NOT PUBLIC DOMAIN.
  65. However, DavisWARE may be distributed at no charge, or for a charge not to
  66. exceed $12 US to cover shipping and media costs.  When secondarily
  67. distributed, DavisWARE must be in its original compressed form and
  68. accompanied by its full documentation.  The distributed software and
  69. documentation may not have been modified in any way.

  72.    No secondary distributor is authorized to "register" an individual
  73. copy of DavisWARE.  Registration fees may only be sent directly to the
  74. author as outlined in the manual on disk.  Note that the registration fee
  75. is exclusive of, and over and above any fees that may have been charged by
  76. a secondary distributor.

  78.    A secondary distributor must notify it's customers that DavisWARE are
  79. shareware programs and that the fee payed by their customer does not
  80. include any fees owed the author for use of this program.

  82.    A secondary distributor must notify the author of their intention to
  83. include this group of files in their distribution.  A secondary distributor
  84. may be granted exceptions to these conditions, only in writing from the
  85. original author.

  87.    The author reserves the right to change any of these conditions without
  88. notice and any changes become retroactive.  Failure to abide by this liscense
  89. agreement may result in either Civil Lawsuit or Criminal charges being filed.

  94.    Shipping and Handling:

  96.       All orders REQUIRE a shipping and handling charge as shown below. 
  97.       These charges cover our costs in shipping your order and tracing
  98.       delivery problems.

  105.       Once your order has been recieved and processed, you will be mailed
  106.       a letter containing your serial number and instructions for using it
  107.       in your configuration file.

  109.       Orders typically require 3 - 4 business days processing time before
  110.       shipment, and may take more or less depending on our order backlog.
  111.       US standard shipping is via UPS Ground, via US Priority Mail where
  112.       UPS delivery is impossible (PO Boxes, Alaska, Hawaii, and APO / FPO
  113.       addresses), and via First Class Mail for diskette-only orders.  US
  114.       2-day shipping is via UPS Blue Label.  All shipping outside the US is
  115.       via Air Mail.  Shipping time varies from 1 business day for UPS
  116.       Ground to New England, to 6 business days for UPS Ground to California,
  117.       to several weeks for countries outside the US where mail service
  118.       is slow.  Express shipping via UPS Red Label or Federal Express is
  119.       available; contact us for rates.

  121.    Payment Terms:

  123.       Personal checks may be subject to a bank clearance delay before
  124.       shipment.  All payments must be made in US funds and drawn on a US
  125.       bank; see below for more details on international orders.  There
  126.       is a $7 charge for all returned checks.  All personal checks must
  127.       be made out to James R. Davis, or you may not receive your order.

  131.       We are happy to accept orders from outside the US, but must require
  132.       payment in the correct form to avoid the exorbitant fees charged by
  133.       US and non-US banks for international check collections.

  135.       Acceptable Payment:

  138.              Checks which are not in US funds and drawn on a US bank must
  139.              unfortunately be returned to you, resulting in significant
  140.              delay in processing your order and additional expense to
  141.              you.
